Your assumption is not right.
Your visa must have a validity date. You can travel out without any problem as long as your travel dates are within that VISA validity date.
No problem if you are not willing to travel..and want to stay in USA. If your H1 is about to expire...then make sure it is extended.

Also if you can set aside some money for >3 years, putting it in an NRO term deposit is also pretty good. Now they range around 7.5 to 8%. You can repatriate the interest income after due taxes are paid.

My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.
Is anybody in the same situation?

what does it mean? If you apply your 485 on July 2nd, within 6 months time (by Jan 2nd) you will get 485 approved?

your I-485 will be adjudicated in 6 months IF and ONLY IF your PD is current and your security checks are cleared. Without these 2 conditions, the processing times are pretty much useless for us.

Today, my friend told me that there is new policy prohibiting employees from paying the H1B application fees for their employers. Has someone heard about this policy? If so, would you please provide me some more details on the issue? Where could I find the policy?
I have got two offers. Both the employers are willing to help me apply for H1B, but I need to pay all the fees by myself. I think that is ok for me. But under this new policy, I am not sure whether this strategy would work out or not. I really very worry about this issue. Your kindly help is highly appreciated!! Million thanks!

Hi,
I have a EB3 labor and 140 approved with PD->12/2002. By 12/2002 I do have 5yrs experience but now (2007) I do have 5yrs experience and I am eligible for EB2.
My question to the gurus is can I use my EB3 PD for EB2 with new employer and can apply for 485 which is current for 12/2002?
Also, while during this transistion/waiting for EB2 labor and 140 with the new company what happens that my previous employer cancels my GC application? Can I still use that PD ?

You need to be one full year outside the US, however the year does not have to be continuous. So if you came back to the US for a month during your year overseas, you would need to be outside the US for 13 months to get H-1B status again. You will be subject to the H-1B cap again if claiming a new 6-year period.
As the previous answer says - you don't have to go back to your home country. You just have to be outside the US.

I am planning to use AC21 to change employers. I signed G28 to allow the attorney for my current employer to represent me before USCIS. Since I signed G28, is it possible for my current employer to withdraw my I-485 application?
Please advise on this...
If I am not mistaken your 485 cannot be withdrawn by your employer after 180 days but they can withdraw your 140 which should not matter after 180 days. I am sure the pro's here will be able to confirm this.
