I equate the situation to a person who sneaks into your house at night and in the morning demands that you respect his human rights and provide him with food and water. No one would tolerate that, yet some how some people think thats ok when it comes to the countries borders.
The church encourages it as most of the illegals are catholics. Poor and illeterate people are usually more likely to attend church and contributes to the churches influence. Believe me, were the Mexicans muslims, Jews or Hindus the church wouldnt care and would probably oppose it. The mosques and temples on the other hand might step in..............
Regarding the children, please understand why they are in this situation. Due to the choices made by their parents.

Please read the headline again. Their strategy is to demonize the law enforcement when ever they try to enforce the law against illegals.

Ching is posting just what he experienced at the CIS office. Having said that, I am not saying what he posted has absolute truth to it. But on the otherhand, the way CIS does things, would anyone be surprised? With all the past experience we have had with CIS and DOS, anything is quite possible. I first came to the US on a tourist visa when I was 15 years old.
I was out of status when my parents couldn't act fast enough to change my status. However, I faithfully maintained my status once I reentered with a student visa.
So here is the history:
Dec. 1986: Enter the US on a tourist visa (age 15)
June 1987: Out of status from the tourist visa for 10 years
Sept. 1996: IIRIRA 96 passes-- 3yr./10yr. reentry bars apply effective April 1, 1997
July 1997: Obtain I-20 for school, leave the US and return to home country (age 26)
Aug. 1997: Reenter US on a F-1 visa
Oct. 00: Initial H-1B
Oct. 03: H-1B extension
Dec.04: RIR filed (priority date)
Sept.06: RIR approved
Oct. 06: H-1B (7th year) extension
Jan. 07: I-140 filed (pending approval)
July 21, 2007: Preparing to file I-485 with the same employer since 2000
So here are my questions:
Q1. The way I interpret the law is that the 3yr./10yr. reentry bars apply when the law went into effect starting April 1997. Is that correct?
Q2. If so, would I have to worry about getting the I-485 approved?
Q3. If not, should I filed for I-485 at all?
Q4. Any suggestions or possiblities to consider?

I'll send the letters when the final draft is ready. I agree though, the final draft should address difficulties faced by both EB2 as well as EB3 if possible. On the other hand the particular argument made in this letter - against the USCIS ad hoc processing and not honoring PDs - is kinda difficult to make for EB3 cases since EB3-I was "U" at the same time. Unfortunately we do not have actual proof from the recent past where USCIS actually processed EB3 applications out of order which we have in case of EB2 category.
What are IV core's thoughts on this campaign? I would like to see some comment from IV core on this idea. If it can be made an official IV action item by the core I bet there will much more momentum behind this.

Here is the problem
-- Grass root & state level efforts work only when there are a lot of grass root workers. For example independence struggle in india worked due to grass root efforts. But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.
Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.
"Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.

However this is only the start... we have a lot of things to accomplish once we return from the celebrations :
- recapture 200K+ unused EB visas
- abolish per country limits on EB visas
- Increase EB visa share by 50K (now that DV is gone)
- 3 yr EADs and APs
.... Any other bright ideas invited...
abolish per country limits on EB visas will back fire us because of diversity issue. We should propose some thing where there is no controversy to reject and that's is recapture 200K visas and EAD/APO for 3 years

I agree. Some idiots are just being irritating pain in the b***.
Someone gave me a "red" with totally unjustified reason. Initially I was upset - and I complained about it - found that he gave me more reds with similar comment from multiple userids (because one userid can't give multiple green/red to the same post). And this guy is doing at weird times ..like 5 in the morning (so psyco is the right description ... now I am sure he is going to given couple of reds to me :D )
After rethinking - now I don't care much about reds - someone is just pissed off, jealous or having fun ... red might make us (and our posts) look less reliable ... however I decided to keep my blood-pressure low and psyco's high :D ..so go ahead psyco - add more reds !!

Do you know why all arguments against F1 to GC are moot? It's because US does NOT view it as misuse. They are talking about not letting the students go, and stapling GC's to certificates. Do you think there will be any result from fighting that sentiment?

We also were in touch with another highly skilled/educated PhD holder from China who was very eager to help but unfortunately his GC process had also not started
