    EB2 for india and China is U as of Aug 21st..maybe that's why..see my post in a seperate thread

    holy cow..if the visas are already U for this Month..

    I am thinking about the probability of the officer opening my case next month and then approving the case? I cant see that happening anyway..

    Very near yet so far..I guess now I clearly understand what that means. :cool:

    I am so sorry to hear about your experience at USCIS.....but that was brave of you to fight back!

    I think you should write to the Ombudsman...do not let this go, we've got to bring to attention the horrors of dealing with USCIS at every stage of our immigration journey. I think there is a call scheduled at 2:00 pm today with the Ombudsman office and USCIS.

    What happened with you is really unacceptable.....we follow thier rules and they are unaware of the rules and announcements they make......if USCIS were a company listed on NYSE they wouldnt survive a day.

    All those ppl who received receipts can you please give us 3 pieces of data

    1) Was there an LUD update on ur I-140 (Last Update Date on the USCIS.gov website)
    2) What Service center did you guys file in?
    3) Do your recept numbers start from LIN or SRC?

    1) The LUD updated from 6/16/2007 to 8/12/2007

    2) I-140 was sent to Texas, approved on 6/15/2007;
    on the I-485 USPS receipt I see that it was received on July 2, 2007 11:34am by B.Gerkensmeyer in Lincoln, NE

    3) I-140 receipt starts with SRC.

    No checks chashed, no word from lawyer.

    Hey you guys - ask not what someone else can do for you but what you can do for someone else...didn't JFK say something like that ;)

    You are ABSOLUTELY correct in saying that all the forums mention EB2 and very little attention is shed on EB3. I wonder why! Is it because EB2 recepients are more actively involved on IV? Or because EB3 recepients are quieter? Both these situations lend themselves to the bias towards EB2. And ultimately lead to one thing - more being done for EB2. I am EB2 and believe you me - I'm not complaining.

    Sadly though, the number of EB3 applicants is many many times the number of EB2. So, there's something to be said for participation and having your voice heard. It is no wonder then that we as a group are dismal at having our collective voices heard - we don't participate like our lives depended on it. And in this case our entire lives depend on what's going on...

    So, instead of bickering and blaming, why don't we awaken the giant that is EB3 India and China and have them participate as well...maybe we'll be able to kill many many birds (country limits, DC rallies, contributions to IV and lobbying activities, phone call campaigns, letter campaigns...) with just one stone....just thinking out loud...that's all...

    Any ideas?

    Exactly.

    I wrote a letter to the university chancellor where I graduated from and urged him to use his power to influence lawmakers to pass STEM -or similar -bills or face the consequences in the form of dwindling enrollment of brilliant students. I used strong but not so harsh words. Refer to the following thread.

    My state chapter leader was also excited about this idea. I posted the letter and the chancellor's response on this forum only to motivate someone 'higher up' to read it, endorse it and make it an action item for everybody (with a US degree). I feel now that I did my part as a dedicated member but the IV leaders (those who have the authority in IV circle) failed to lead my initiative or take it to a higher level (may be I am not able to find better words here).

    Usually discussions get buried in forums. People open all sorts of threads and discuss - which is fine, but when some real effort is going on - I recommend the person who is behind it to own the effort. Thats what IV is - everyone MUST own the effort from start to finish and not give up or pass it on.

    It is difficult for people to spend the time and effort in a thankless job. And we all need a lot of motivation and courage to do things. We are all professionals and currently dealing with politics and bureaucracy - must understand how difficult it is.

    Below is for all readers

    I just read the messages from Aman and Pappu - their tone is understandable - they are definitely stressed because they have to deal with all this. Am sure they are definitely looking for committed individuals who can help them and who can be trusted. There must be more than 100% commitment to do what they are doing.
    Is it possible for everyone to commit themselves at that level?

    If not can people do the following at the least?
    (1) Provide correct information
    (2) Contribute monetarily
    (3) Join State chapter
    (4) balance their schedules and create some time for IV and do at least something
    (5) Stop crap talk and blame games and concentrate only on useful stuff
    (6) Contribute in any other way - publicity, convincing friends, coming up with innovative ideas .....
    (7) Channelize all your frustration into positive energy.

    Based on commitment, availability, skill, trust IV can definitely utilize your help in different levels, maybe ann admin, maybe a chapter lleader, maybe a chapter member , maybe a media coordinator ...... Do you have that in you? Are you willing to do it??

    Sir/Madam,

    On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration �services� provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

    We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS � a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us � �Case adjudication is based on receipt date� �No, we process applications based on notice date�, �Actually, it�s the processing date that determines which applications are adjusted.� !!!

    Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their �service� centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America�s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service � once applications are submitted to USCIS they disappear into a black hole. Barring a website where one can nominally check one�s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

    Another inconsistency, surfacing in August 2008, begs redressal � while I-485 applicants (albeit those from 2006 instead instead of earlier years) at the TSC were being approved in a steady stream, the NSC was almost completely inactive resulting in only a very few cases being approved prior to August 20th. After this date, the NSC appeared to completely hold off on all I-485 approvals while approvals continued at the TSC. Could somebody please account for this preferential treatment for I-485 applicants at the TSC versus those at the NSC? Furthermore, when complaint faxes were sent in to the NSC in protest, instead of issuing a formal statement to explain their approach, the NSC retaliated by issuing a bunch of RFEs. Is the USCIS trying to intimidate us so that we remain quiescent??

    While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled � we are bound to our sponsoring employer from the start to the end of an extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

    We request you to lend us your ear and address these issues so that we are not subjected to them in the future. Kindly note that there remain roughly 15 days until the October 2008 visa bulletin goes into affect. Once October arrives, the dates for Indian EB2 candidates retrogress to 2003. We believe you have the power to help a few more of us who have been waiting, seemingly endlessly, to get out of this immigration limbo.

    Go for another M.S. to maintain F1. It doesn't have to be a phD.
    In that case I would say go for PhD. Directly file GC under EB1 - no hassle no retrogression :)

    Most of you complaining here are the ones who have not ever contributed to IV. You come here to vent out your frustration. That's easy way out. If you really want to do something +ve for yourself, support IV and its efforts instead.

    Hi,
    I am married and my husband is working in US on H1B visa. I came into the country with an L1 visa in Dec '06. The I 94 is valid till Oct 2009.
    In Apr 2007, I applied for my H1B and it was approved with a start date of October 2007.
    I quit my company by end of May 2007. Since the H1B was NOT applied with COS, I applied for my H4 last week but I have not got the approval notice for H4 yet. :(

    Is it still possible for my husband to file my 485 along with his? What do I enter for questions regarding my current status?? Can I say that my current status is H4 and give the "valid till" date as the end date of my husband's H1B date?
    Please help!!!

    Mine was filed in TSC and it moved to CA and then moved back to TSC. The place originally filed will be considered.

    Once again those who have already received RFEs know for sure that their files have been touched and many of these are outside the RD or ND of the I-485 filing.

    So USCIS is like a fish market and no logic whatsoever be applied...we can all reason but it is futile...just like the stock market which can go in any direction so is output from USCIS.

    Correct me please if I am wrong.

    With all of the anthrax scares going on I'd be very surprised if they even allowed the flowers to be delivered to the building (especially if they are accompanied with get well soon cards). You may want to make sure that the flowers are being signed for and delivered before you send any more.

    Some of the members are so used to "short cuts" in their life. They hope they can get their GC tomorrow by pulling down another one in the queue. They are not willing to come in terms with the reality that retrogression is due to insufficient visa numbers and country cap.
